1. Introduction and agreement

These Terms and Conditions ("Terms") form a binding agreement between you ("User", "you") and Khula Information Systems cc., a close corporation registered in the Republic of South Africa ("AutoMedic", "we", "us"), operator of automedic.co.za and the AutoMedic application (the "Platform") and all associated services (the "Services").

By accessing or using the Platform you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Platform.

If you register on behalf of a business or another person, you warrant that you are authorised to accept these Terms on their behalf.

2. What AutoMedic is

AutoMedic is an online marketplace that connects vehicle owners ("Customers") with independent service providers ("Providers") offering:

  • Car wash services;
  • Vehicle detailing, including full vehicle polish and paint correction;
  • Vehicle repairs, servicing and maintenance.

Customers post service requests. Providers within range may ask questions and submit quotes. The Customer chooses a quote. AutoMedic then provides tools — messaging, job cards, work logs and ratings — to help both parties manage the work.

AutoMedic is an introduction platform only. We are not a mechanic, workshop, car wash or detailing business. We do not perform, supervise, inspect, guarantee or take responsibility for any work. Any agreement to carry out and pay for work is concluded directly between the Customer and the Provider. AutoMedic is not a party to that agreement.

3. Eligibility

You must be at least 18 years old to use the Platform. By using it you warrant that you are 18 or older and have legal capacity to contract.

Providers additionally warrant that they are lawfully entitled to conduct their business in South Africa, hold any licences, registrations, permits and insurance their activities require, and are tax compliant.

4. Accounts

  • You must provide accurate, current and complete information, and keep it updated.
  • You are responsible for keeping your password confidential and for all activity under your account.
  • One person or business per account. You may not share, sell or transfer an account.
  • Notify us immediately at support@automedic.co.za if you suspect unauthorised access.
  • You may delete your account at any time under Settings → About → Delete my account.

5. No vetting or endorsement of Providers

Providers register themselves and supply their own business information, photographs and descriptions.

AutoMedic does not:

  • Verify the qualifications, competence, experience, registration, insurance or tax status of any Provider, unless a Provider is expressly marked as "verified", in which case only the specific checks described at the time have been carried out;
  • Conduct criminal, credit or background checks on Providers;
  • Recommend, endorse, warrant or guarantee any Provider, their workmanship, parts, pricing or conduct;
  • Inspect any workshop, premises, tool or vehicle.

You are solely responsible for choosing a Provider. Before allowing work to proceed, you are strongly encouraged to confirm the Provider's identity, experience, insurance and references, agree the scope and price in writing, and — for significant work — obtain more than one quote.

6. Quotes, prices and the final total

  • Quotes are estimates supplied by Providers. A quote may be a fixed price or a range.
  • The final total recorded on a job card may differ from the quote where the work required proves greater or lesser than expected. Any variation must be agreed between Customer and Provider. AutoMedic does not set, control, approve or guarantee prices.
  • Unless stated otherwise by the Provider, quoted amounts are inclusive of VAT where the Provider is VAT registered. Customers should confirm this with the Provider.
  • Accepting a quote through the Platform indicates your intention to engage that Provider. It does not create any obligation on AutoMedic.

7. Payment

AutoMedic does not process payments and does not hold funds in escrow. Payment is made directly by the Customer to the Provider by whatever means they agree.

AutoMedic is not responsible for non-payment, underpayment, overcharging, refunds, deposits, invoices, receipts or any financial dispute between the parties. Providers are responsible for issuing invoices and for their own tax obligations.

The Platform is currently free to both Customers and Providers. We may introduce fees, commissions or paid features in future; any such change will be notified in advance and will apply only from the date it takes effect.

8. Cancellations and no-shows

  • A Customer may cancel or delete a request at any time before accepting a quote.
  • Once a quote is accepted, cancellation terms are a matter between the Customer and the Provider. Providers are encouraged to state cancellation terms in their quote.
  • Repeated no-shows, cancellations after acceptance, or requesting quotes with no intention of proceeding may result in suspension of your account.

9. Address and contact details

To protect Customers, your street address and telephone number are withheld from Providers while a request is open, and are released only to the Provider whose quote you accept.

Providers who receive a Customer's address and contact details:

  • May use them only to carry out that specific job;
  • May not use them for marketing, add them to mailing lists, or share, sell or publish them;
  • Must comply with POPIA in respect of any personal information they receive, as an independent responsible party.

Misuse of Customer details is a material breach of these Terms and will result in removal from the Platform, in addition to any legal consequences.

10. Safety

Engaging a Provider often involves admitting a stranger to your home or handing over your vehicle. You accept that you do so at your own risk, and you are encouraged to:

  • Verify the identity of anyone who arrives, and check that the vehicle matches the Provider's profile;
  • Not leave valuables or personal documents in a vehicle handed over for work;
  • Record the condition of the vehicle, with photographs, before and after work;
  • Report any concerning conduct to us at support@automedic.co.za and, where a crime may have been committed, to the South African Police Service.

AutoMedic accepts no liability for the conduct of any user, whether on or off the Platform.

11. Work quality, warranties and disputes

All warranties or guarantees on workmanship and parts are given by the Provider, not by AutoMedic. Providers remain responsible for compliance with the Consumer Protection Act 68 of 2008 where it applies to them.

If a dispute arises, the parties must first attempt to resolve it directly. AutoMedic may, at its discretion and without obligation, supply relevant records — request details, quotes, messages, job-card entries and photographs — to assist. We do not adjudicate disputes, and we are not liable for their outcome.

12. Ratings, reviews and user content

Where the Platform allows you to submit reviews, ratings, photographs, messages, job notes or other material ("User Content"), you agree that:

  • You are solely responsible for it;
  • Reviews reflect your genuine, first-hand experience;
  • It is not false, misleading, defamatory, obscene, harassing, discriminatory or unlawful;
  • It does not infringe any third party's intellectual property, privacy or other rights;
  • You have the right to share any photograph you upload;
  • You will not post another person's personal information without their consent.

You grant AutoMedic a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, adapt and display your User Content for the purpose of operating and promoting the Platform. You retain ownership of your content.

We may remove, decline to publish, or moderate any User Content at our discretion, without notice. We do not routinely pre-screen content, and we are not responsible for opinions expressed by users.

13. Acceptable use

You agree not to:

  • Use the Platform for any unlawful or fraudulent purpose;
  • Post false, misleading or duplicate requests or quotes;
  • Circumvent the Platform to solicit users for purposes unrelated to the job at hand;
  • Harass, threaten, defame or discriminate against any user;
  • Damage, disable, overburden or impair our servers or networks;
  • Attempt to gain unauthorised access to any part of the Platform, any account or any system;
  • Copy, modify, reverse-engineer or decompile any part of the Platform;
  • Use bots, scrapers or automated tools to access, index or extract data;
  • Harvest or store other users' personal information, or send them unsolicited communications;
  • Impersonate any person or misrepresent your affiliation with any person or business;
  • Remove any proprietary notice from the Platform.

14. Protection of personal information

We process personal information in accordance with POPIA. Full details of what we collect, why, who we share it with, how long we keep it and your rights are set out in our Privacy Policy, which forms part of these Terms.

15. Availability

We aim to keep the Platform available but do not guarantee uninterrupted access. We may suspend, withdraw or restrict all or part of the Platform for maintenance, upgrades or business reasons, without liability.

16. No warranties

The Platform and Services are provided "as is" and "as available", without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Platform will be uninterrupted, error-free, secure or free of harmful components, that information on it is accurate, complete or current, or that any particular result will be achieved.

17. Limitation of liability

To the maximum extent permitted by South African law, Khula Information Systems cc., its members, directors, employees, agents and contractors are not liable for any direct, indirect, incidental, special, consequential or punitive loss or damage arising from:

  • Your use of, or inability to use, the Platform;
  • Any work performed or not performed by a Provider, including defective workmanship, damage to a vehicle or property, delay, injury or loss;
  • The conduct of any user, on or off the Platform, including theft, dishonesty or misuse of information;
  • Any quote, price, final total, payment or financial dispute;
  • Reliance on any information obtained through the Platform;
  • Unauthorised access to or alteration of your data, save where caused by our failure to take reasonable security measures.

Nothing in these Terms limits any liability that cannot lawfully be excluded, including under the Consumer Protection Act.

18. Indemnity

You indemnify and hold harmless Khula Information Systems cc., its members, directors, officers, employees and agents against all claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees on an attorney and own client scale) arising from your use of the Platform, your breach of these Terms or any law, your infringement of third-party rights, your User Content, or any dispute between you and another user. This clause survives termination.

19. Intellectual property

All content on the Platform — text, graphics, logos, icons, software and data compilations — belongs to Khula Information Systems cc. or its licensors and is protected by South African and international law. You receive a limited, non-exclusive, non-transferable, revocable licence to use the Platform for its intended purpose. You may not reproduce, distribute, republish, sell, modify or exploit any part of it without our written consent.

20. Suspension and termination

We may suspend or terminate your access at any time, with or without notice, if you breach these Terms, if we are required to do so by law, if we reasonably suspect fraudulent, unsafe or abusive conduct, or if your account is dormant for an extended period. You may stop using the Platform and delete your account at any time. Clauses that by their nature survive termination — including 11, 12, 17, 18, 19 and 22 — continue to apply.

21. Changes to these Terms

We may amend these Terms at any time. The current version is always on the Platform with an updated "Last updated" date. Material changes will be notified by email or a prominent in-app notice. Continued use after changes take effect constitutes acceptance. If you do not agree, you must stop using the Platform.

22. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa.

Any dispute arising out of or in connection with these Terms shall be referred to and finally resolved by arbitration administered by the Arbitration Foundation of Southern Africa ("AFSA") under its expedited rules, before one arbitrator appointed under those rules. Nothing prevents either party from seeking urgent interim relief from a competent court, or from approaching the Consumer Goods and Services Ombud, the National Consumer Commission or the Information Regulator where applicable.

23. Electronic communications

You consent to receiving communications from us electronically, and agree that electronic communications satisfy any legal requirement that a communication be in writing, in terms of the Electronic Communications and Transactions Act 25 of 2002.

24. Severability, assignment and waiver

If any provision is found unlawful or unenforceable, it will be severed and the remaining Terms continue in force. We may assign our rights and obligations without notice; you may not without our written consent. Our failure to enforce any provision is not a waiver of it.

25. Entire agreement

These Terms and the Privacy Policy constitute the entire agreement between you and Khula Information Systems cc. regarding the Platform, superseding all prior agreements on the same subject.
